1.Mysalespunch.com - Terms of Access and Intellectual Property Rights

Use of this website and the rights to the design, pictures, logos and content of this website are the exclusive property of Salespunch Ltd. The “mysalespunch" logos are trademarks owned by Salespunch Ltd and all intellectual property rights are protected. You may not copy, reproduce, modify, distribute, publish, display, store, post or transmit (or purport to authorise the same) any part of this site or any of its contents directly or indirectly, without the express written permission of Salespunch Ltd.

2. Mysalespunch.com – Pricing

All of our prices are quoted and charged in UK Sterling at the point of purchase. Other currencies, where shown, are a guideline and will be converted to UK Sterling at the prevailing exchange rate when an on-line purchase is completed. All on-line purchase receipts will show the exact amount charged in UK Sterling. The prices quoted are inclusive of 20% Value Added Tax. We use the Paypal service to process all transactions. Our exchange rates are clearly shown at point of purchase and updated regularly in line with Paypal’s exchange rates at the prevailing time.

3. Mysalespunch.com - Conditions of Sale and Delivery

Individual members or organisations acting on behalf of members are required to purchase the appropriate Mysalespunch.com membership package prior to using the materials and modules within the membership area of the site. This may be done by either entering valid Paypal details at the time of purchase or by pre-paying for group membership by setting up a corporate account directly with Salespunch Ltd.

Individual Purchases

A membership package purchased by an individual may be solely accessed by the member for a period of 12 months from the date of purchase using the login and password details generated by the Mysalespunch.com system. At the end of the 12 monthly period, the 'year 2' membership package will be made available for purchase. Membership access will automatically expire if the 'year 2' package is not purchased or if monthly payments are ceased. Once purchased, the membership resources may be accessed as many times as required during the qualifying period, provided that they are accessed solely for the personal use of the individual member. Once payment is made successfully and the Mysalespunch.com system has generated the login and password no refund will be made, regardless of whether the member has accessed the mysalespunch membership resources), except at the absolute discretion of Salespunch Ltd Directors. In the event that the Mysalespunch.com system is unavailable to the member for more than twelve hours within a twenty-four hour period, one additional day will be added to the original expiry date for the module per twelve hour unavailability period within the 12 month period. Any unavailability as a direct result of system malfunction must be brought to the attention of Salespunch Ltd in writing, within the 12 month period of access. Client support and service including any complaints will only be dealt with by e-mails sent to info@mysalespunch.com. A response to each e-mail will normally be provided within 2 working days.

Corporate Accounts

Where an organisation purchases a 'corporate licence' for usage of the Mysalespunch.com modules from Salespunch Ltd the terms of access will be specifically defined within the licence, however in its absence all terms set out within these Terms and Conditions of Business will apply.

4. Mysalespunch.com – Disclaimer

Salespunch Ltd does not give any warranty or other assurance as to the operation, quality or functionality of the Mysalespunch.com resources. Salespunch Ltd staff and its associates reserve the right not to discuss the content of any of the resources with the individual or organisation. Salespunch Ltd does not give any warranty or other assurance as to the content of any information available through Mysalespunch.com, its accuracy, completeness, timelessness or fitness for any particular purpose. To the full extent permissible by law, Salespunch Ltd disclaims all responsibility for any damages or losses (including, without limitation, financial loss, damages for loss in business projects, loss of profits or other consequential losses) arising in contract, tort or otherwise from the use of Mysalespunch.com or any material referred to in the modules, or from any action or decision taken as a result of using Mysalespunch.com materials. All of our employee comments, whether written or verbal, are also covered by this disclaimer.

5. Mysalespunch.com – Refunds

Salespunch Ltd is unable to make refunds once an on-line order has been completed, except in the exceptional circumstances detailed within these terms and conditions and expressly at the discretion of its Directors.

6. Mysalespunch.com - Receipts, Billing and Settlement

Our only receipt is the one provided on-line at the time of ordering therefore it is important that clients print and/or save these receipts. Any errors should be raised with us by e-mail within 48 hours of receiving the on-line receipt. Mysalespunch will endeavour to rectify any such mistakes within 48 hours of receiving an appropriate request from a client.

7. Mysalespunch.com – Legal and Arbitration

Our Terms and Conditions do not affect our clients’ statutory rights under the following English Consumer Law: The Sale of Goods Act 1979; The Supply of Goods and Services Act 1982; The Consumer Credit Act 1974; The Trade Descriptions Act 1968; The Unfair Contract Terms Act 1977 and the 1994 Regulations; The Consumer Protection Act 1987, and we operate under the Laws of England and Wales . The validity, construction and performance of this contract shall be governed by the Law of England and Wales and any dispute that may arise out of or in connection with this contract including its validity, construction and performance shall be determined by arbitration under the Rules of the London Court of Arbitration at the date hereof, which Rules with respect to matters not regulated by them incorporate the UNCITRAL Arbitration Rules. The parties agree that service of any notices in reference to such arbitration at the addresses as given in the contract shall be valid and sufficient.

8. Mysalespunch.com - Data Protection and Privacy Policy

Salespunch Ltd adheres strictly to all current Data Protection legislation, including the Data Protection Act 1998. We do not pass client names, addresses or other details to any other organisations for marketing or other purposes.

The Mysalespunch.com domain name is owned by Salespunch Ltd, a limited company registered in England on 11 June 2003, registration number 04795926 Registered Offices: Forum House, Stirling Road, Chichester, West Sussex, PO19 7DN England.

 

PRIVACY POLICY

The Information We Collect and Use:

By information we mean information about you collected through our Service website(s), including your email address and other information you provide to us by registering for our services or making requests for information about our services. When visitors request pages from the Site or click on a link in a mailing sent through the Service, our servers log the visitors' IP addresses. We reserve the right to use IP addresses to identify a visitor or list member when it will enhance the users experience or if we feel it is necessary to enforce compliance with the Site's policies or to protect Company, the site, its visitors, the Service, our Internet Service Provider partners, the list members or others.

Cookies

Cookies are pieces of information that a websites transfers to an individual's hard drive for record-keeping purposes. Clear Gifs (Web Beacons / Web Bugs)

In contrast to cookies, which are stored on a user's computer hard drive, clear gifs are embedded invisibly in HTML files and are about the size of the period at the end of this sentence. We may use clear gifs in our HTML-based emails to let us know which emails have been opened by recipients.
